Terms & Conditions

Last updated: 2 September 2026

Welcome to Collette Quinlan Art.

This website is operated by Collette Quinlan trading as Collette Quinlan Art. Throughout these Terms & Conditions, “I”, “me”, “my”, “we”, “us” and “our” refer to Collette Quinlan Art.

By accessing this website, purchasing an artwork, placing an order or otherwise using this website, you agree to these Terms & Conditions.

Please read them carefully before making a purchase.

Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or remedies that cannot legally be excluded under the Australian Consumer Law or other applicable legislation.

Artwork information

I take reasonable care to ensure that artwork descriptions, photographs, dimensions, materials, pricing and other information displayed on this website are as accurate as possible.

However, original artworks are handmade objects and slight variations, irregularities, texture, surface marks and differences between pieces are part of the nature of original artwork.

Artwork dimensions are measured manually and minor variations may occur.

Photographs are intended to represent each artwork as accurately as reasonably possible. However, colours, tones, texture, metallic elements and surface details may appear differently depending on photography, lighting conditions, your device, screen settings and monitor calibration.

Where artwork is photographed or digitally represented within an interior or styled setting, these images are intended as a visual guide only. Scale, colour and proportions may not be exact unless specifically stated.

If exact colour, dimensions, texture or another characteristic is particularly important to you, please contact me before purchasing and I will be happy to provide further photographs, measurements or information.

Website errors, inaccuracies and omissions

Despite taking reasonable care, this website may occasionally contain typographical errors, technical errors, incorrect measurements, inaccurate descriptions, incorrect prices, incorrect shipping charges, availability errors or other inaccuracies or omissions.

I reserve the right, subject to applicable law, to correct an error or update information on the website at any time.

This includes errors relating to:

product descriptions

artwork dimensions

materials

pricing

discounts or promotions

availability

shipping charges

courier calculations

delivery information

website functionality

or any other information relating to an artwork, product or service.

If an error affects an order you have already placed, I will contact you as soon as reasonably possible.

Depending on the circumstances and to the extent permitted by law, I may offer you the opportunity to proceed with the corrected information or cancel the affected order and provide a full refund.

You will never be required to pay an additional amount resulting from an error without first being informed and agreeing to that additional cost.

Pricing

All prices displayed on this website are in Australian dollars unless otherwise stated.

Prices may be changed at any time before an order is accepted.

While reasonable care is taken when entering prices, occasionally an artwork may be incorrectly priced because of human error, technical error or a website malfunction.

Where permitted by law, I reserve the right not to accept or to cancel an order affected by a genuine pricing error.

If payment has already been processed and the order is cancelled, the amount paid for the affected item will be refunded in full.

Nothing in this section overrides any obligations relating to displayed prices under Australian Consumer Law.

Orders and acceptance

Submitting an order through this website constitutes an offer to purchase the selected artwork or product.

An automated order or payment confirmation acknowledges that your order has been received. It does not necessarily mean that the order has been finally accepted.

Orders remain subject to confirmation of:

availability

correct pricing

correct product information

delivery feasibility

and, where applicable, shipping or courier requirements.

Where permitted by law, I reserve the right to decline or cancel an order before dispatch where there has been a genuine website error, inventory error, pricing error, duplicate sale, payment issue, suspected fraudulent transaction or other circumstance that prevents the order from being fulfilled.

Where an order is cancelled by Collette Quinlan Art, any amount already paid for the cancelled item will be refunded.

Original artwork availability

Original artworks are one of a kind unless otherwise stated.

Artwork may occasionally be offered through more than one sales channel, including exhibitions, galleries, art shows, social media or direct enquiries.

Although I make every reasonable effort to update availability promptly, there may occasionally be circumstances where an artwork is sold through another channel shortly before an online purchase is completed.

If an artwork is no longer available, I reserve the right to cancel the affected order and issue a full refund.

Payment

Payment is required in full at the time of purchase unless another arrangement has been agreed in writing.

Payments made through the website may be processed by third party payment providers.

Your use of those payment services may also be subject to the provider’s own terms, conditions and privacy policies.

An artwork will not be dispatched until all amounts required for the artwork and any applicable shipping or freight costs have been paid.

Shipping and delivery

Australia wide delivery is available for eligible artworks.

Small and medium artworks may be shipped using Australia Post at the shipping rate shown at checkout.

All artworks sent using Australia Post will be carefully packaged, tracked and require a signature on delivery.

Where available and appropriate, Australia Post Extra Cover will be purchased to cover the declared sale value of the artwork, subject to Australia Post’s limits, exclusions, terms and conditions.

Large and oversized artworks require specialist courier freight.

Because courier pricing varies according to artwork dimensions, destination and delivery requirements, courier freight may be quoted separately after purchase.

If you would prefer to know the courier cost before purchasing a large artwork, please contact me with the artwork name and delivery postcode and I can arrange a quote.

Incorrect or underestimated shipping charges

Shipping calculations displayed by a website or checkout system may occasionally be incorrect, particularly for large, oversized, regional or unusually packaged artworks.

If the shipping amount charged at checkout is incorrect or does not cover the delivery method reasonably required to safely transport the artwork, I will contact you before dispatch.

You may then choose to:

pay the corrected shipping or courier amount and proceed with the order, or

cancel the order and receive a full refund for the affected artwork.

I will not charge an additional shipping amount without your agreement.

Where a genuine shipping error makes fulfilment impractical or impossible, I reserve the right, to the extent permitted by law, to cancel the order and refund all amounts paid.

Delivery timeframes

Any dispatch or delivery timeframes provided on this website are estimates only unless expressly stated otherwise.

Delivery times may be affected by Australia Post, courier availability, regional delivery schedules, weather, public holidays and other circumstances outside my reasonable control.

I am not responsible for delays caused solely by circumstances outside my reasonable control, except to the extent that responsibility cannot be excluded under applicable law.

Tracking information will be provided where available.

Delivery address

Customers are responsible for providing a complete and accurate delivery address when placing an order.

Please check your delivery information carefully before completing your purchase.

If an artwork is returned because an incorrect or incomplete address was supplied by the customer, reasonable additional postage, courier or redelivery costs may be payable before the artwork is sent again.

This does not apply where the address error was caused by Collette Quinlan Art.

Signature on delivery

Artworks sent using Australia Post require a signature on delivery.

If nobody is available to receive the parcel, Australia Post may redirect the parcel for collection or otherwise deal with it in accordance with its delivery procedures.

Please monitor the tracking information supplied with your order.

Damage or loss in transit

Every artwork is carefully packaged before leaving the studio.

Where an artwork is sent through Australia Post, appropriate Extra Cover will be purchased for the declared sale value where the artwork and postal service are eligible for that cover.

If an artwork arrives damaged, please photograph the artwork, external packaging, internal packaging and shipping label as soon as possible and retain all packaging.

Please contact me promptly with the photographs and order details.

Australia Post may require the recipient to provide information, attend a Post Office, make the damaged item and packaging available for inspection, or participate directly in its claim process.

Where this occurs, the customer agrees to reasonably cooperate with the requirements of Australia Post.

I will provide reasonable supporting documentation available to me, including proof of purchase, proof of value and proof of lodgement where required.

Any insurance or compensation available through Australia Post is subject to Australia Post’s own terms, conditions, exclusions and assessment process.

Nothing in this section limits any rights you may have against Collette Quinlan Art under the Australian Consumer Law.

Local collection and Melbourne delivery

Where offered, artworks may be collected locally by prior arrangement.

Local Melbourne delivery may also be available for selected artworks and locations.

Details will be agreed before delivery or collection.

Responsibility for an artwork following successful collection by the purchaser is subject to applicable law.

International shipping

International shipping may be available for selected artworks by prior arrangement.

Please contact me before purchasing if international delivery is required.

International customers are responsible for any customs duties, import taxes, fees or charges imposed by the destination country unless otherwise agreed.

International shipping availability, insurance and delivery arrangements will depend on destination, artwork size and carrier restrictions.

Returns and change of mind

Because artworks are original and individual pieces, Collette Quinlan Art does not generally accept returns or exchanges simply because you change your mind.

Please consider the artwork dimensions, colours, materials and suitability for your space carefully before purchasing.

I am happy to provide additional photographs, video, measurements or information before purchase if required.

This change of mind policy does not affect your rights under the Australian Consumer Law where an artwork is faulty, damaged, materially different from its description or otherwise fails to meet an applicable consumer guarantee.

Faulty or incorrectly described products

Your purchase comes with rights and guarantees that may apply under the Australian Consumer Law.

Nothing in these Terms & Conditions excludes, restricts or modifies those rights where they apply.

If you believe your artwork has a fault or is materially different from the description provided at the time of purchase, please contact me with your order details and photographs so the issue can be assessed.

Commissions

Where commissions are offered, additional commission terms may apply and will be provided or agreed as part of the commission process.

Unless otherwise agreed in writing, a 50% deposit is required before work begins.

Because a commissioned artwork is created specifically for the customer, change of mind cancellation may result in some or all of the deposit being retained to cover work undertaken, materials purchased and costs reasonably incurred, to the extent permitted by law.

The nature of original artwork means that commissioned pieces will not be exact reproductions of another artwork.

References, colours, compositions and previous works may be used as creative direction, but reasonable artistic variation should be expected.

Any estimated completion timeframe is an estimate and may vary depending on the scale and complexity of the artwork.

Nothing in these commission terms excludes rights that cannot legally be excluded.

Intellectual property and copyright

Purchasing an original artwork transfers ownership of the physical artwork only.

Unless expressly agreed otherwise in writing, copyright and all other intellectual property rights in the artwork remain with Collette Quinlan / Collette Quinlan Art.

The artist retains the right to photograph, publish, display and reproduce images of the artwork for purposes including:

the Collette Quinlan Art website

social media

portfolio and archival records

exhibitions and publications

marketing and promotion

prints or reproductions

digital works

and other artistic or commercial uses.

Purchasing an original artwork does not give the purchaser the right to reproduce, manufacture, distribute, licence, commercially exploit or create derivative products from the artwork.

Please contact Collette Quinlan Art if you would like permission to use an artwork commercially.

Website content

Unless otherwise stated, all artwork images, photographs, text, graphics, branding, designs and other content appearing on this website are owned by or licensed to Collette Quinlan Art and are protected by applicable intellectual property laws.

Website content may not be copied, reproduced, modified, distributed, published, commercially exploited or used to train, create or reproduce commercial imagery without prior written permission, except where permitted by law.

Sharing images through social media for genuine personal or editorial purposes is welcome where Collette Quinlan / Collette Quinlan Art is clearly credited.

Website availability

I make reasonable efforts to keep this website accessible and functioning correctly.

However, I cannot guarantee that the website will always operate without interruption, technical faults, delays or errors.

The website may occasionally be unavailable because of maintenance, hosting issues, third party services or circumstances beyond my reasonable control.

To the maximum extent permitted by law, Collette Quinlan Art is not responsible for loss caused solely by temporary website unavailability or technical interruptions outside my reasonable control.

Third party services and links

This website may contain links to, or use services provided by, third parties including payment processors, shipping providers, social media platforms and other external websites.

I do not control third party websites and am not responsible for their independent content, security, availability or privacy practices.

Customers should review the applicable terms and privacy policies of third party services where appropriate.

Limitation of liability

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded.

To the maximum extent permitted by law, Collette Quinlan Art will not be liable for indirect, incidental or consequential loss arising solely from the use or inability to use this website, reliance on general website information or events outside our reasonable control.

Any exclusion or limitation contained in these Terms applies only to the extent permitted by law.

Privacy

Personal information collected through this website is handled in accordance with the Collette Quinlan Art Privacy Policy.

Third party website, payment and ecommerce providers may also collect and process information in accordance with their own privacy policies.

Changes to these Terms

These Terms & Conditions may be updated from time to time to reflect changes to the website, business practices or applicable requirements.

The current version will be published on this page together with the date it was last updated.

Changes will apply to future use of the website and future transactions from the date they are published. They will not retrospectively alter the agreed terms of an existing order except where required or permitted by law.

Severability

If any part of these Terms & Conditions is found to be invalid, unlawful or unenforceable, that provision will be interpreted or removed only to the extent necessary.

The remainder of the Terms & Conditions will continue to apply.

Governing law

These Terms & Conditions are governed by the laws applicable in Victoria, Australia.

Nothing in this clause limits any rights a consumer may have under applicable Australian consumer legislation.
